Special Department appoints one month's detention of three persons suspected of several criminal acts

The Constitutional Court in Pristina, the Special Department, has ruled on the request of the Special Prosecutor of the Republic of Kosovo for the appointment of the detention measure in the criminal case against indictees S.D., B.K. and A.A.
“due to suspicion that criminal acts have been committed, participation or organisation of the organised criminal group, as regards criminal acts fraud and commitment, in co-ordination have committed a criminal offence, the B.K. defendant, due to criminal work import, export, supply, transport, production, exchange, unauthorized mediation or sale of weapons or explosive materials, ownership and sale of unauthorized narcotics, psychoophylogic substances and analogs, indictees and BK. Co-ordination has carried out the criminal act facilitating and financing in carrying out terrorism, defendant S.D., due to the criminal offence of possession, control or unauthorized possession of weapons, and defendant A.A., due to criminal work Import, export, supply, transport, production, exchange, mediation or sale of unauthorized weapons or plastic explosive”, the report said.
The preliminary procedure judge has approved the Special Prosecutor's request of the Republic of Kosovo for the appointment of the detention measure against indictees S.D., B.K. and A.A., setting the measure of detention for one month each.
After holding the hearing, the Court appreciates that the appointment of the detention measure to this criminal case is adequate, as there is a real danger that if the defendants are set free, they can escape in order to hide and flee from criminal responsibility. The court also estimates that if the defendants are released, there is the danger that the same will repeat criminal acts, as well as influence witnesses, so it found that the detention measure for the time being is the only measure for the unhindered flow of criminal procedure to this criminal case”, the report noted.
Against this act, disgruntled parties have the right to complaint at the Court of Appeals, through the Constitutional Court in Pristina.
