CAS confirms FFK decision in FC Pristina complaint case

The Kosovo Football Federation has announced that the Court of Arbitrazhi Sports in Lozanne (Court of Referee for Sports The CAS) has decided in favour of the FFK on the case initiated over the Kosovo Artitrazhi Sportistic Court's decision (GJAS) in the FC Pristina case.
“The CAS has proved the FFK's decision not to compromise FC Pristina for the 2023/24 contestary edition of European competitions, giving full legitimacy to its actions in line with regulations in force”, the FFK said.
In this case, the CAS has clearly confirmed that the FFK does not submit to the jurisdiction of the GJAS, thus confirming its autonomy and independence as the country's top football body.
At the 186th point of the decision, the panel stresses from the evidence presented at the session that there has been no objections to the fact that FC Pristina had been trained for the process of licensing from FFK's license manager, Bajram Shala, and had long been announced that the third degree of complaint was in the CAS in Switzerland.
Moreover, according to NFFC, the club should have taken into account even the NFF statute and the U rule EFA for the license of clubs, which points out that, in case a member federation has a three-bubanalage setting, then it is this organ that decides on the jurisdiction of the club licensing system.
As it is further in the decision, it is confirmed that, the NFF statute defines the competent organ for the licenization issues at Article 58. Meanwhile, Article 67.1's combined interpretation of Article 58 makes it clear that the decisions of the Appeal of License Organization can only be rejected in the CAS in Loza, according to the statuteic provisions. Taking into account also the CAS statute definition with headquarters in Lozanne, it turns out that the competent body was CAS in Switzerland, rather than GJIS in Kosovo.
At the conclusion of the decision, the panel estimates that GJAS had no jurisdiction to review the complaint against the second degree ruling.
