Two accused of terrorist attack in Banjska are quietly protected, third to be declared at next session

This happened on Friday at the Foundation Court, where the court consisting of Chairman Arrenjim Arni and the members of Beqiri and Donika Shala Abdyli, has made decisions regarding the management of evidence in the case known as “Banjska”, reports the “Bettim for Justice”, broadcast. Periscope.

During the hearing, the representative of the injured presented material evidence, including medical reports and photographs of the injuries of Alban Rashit and the Shaqiri Liberation, who was the only one in session from the injured. According to him, Rashi continues to be in medical treatment and unable to work as a result of injuries sustained during the attack, where Kosovo's hero, Africa Bulnjak, also lost his life.

He also rejected a test presented by the defense of accused Blagoje Spasojevic, namely a degree allegedly testifying to his profession as medical technician. According to him, the prosecution's evidence shows that Spasojevic has been arrested informed and armed, stressing that “was not the person who healed the wound, but the one who caused them”.

The court decided to accept evidence submitted by the Special Prosecutor and defence at the preliminary hearing. As far as objections are concerned about the legality of the telephone examination, the court estimated they are legal, based on previous rulings by the Court of Appeals.

Similarly, the defence proposal for admission was approved as proof of a witness's statement, which could not be submitted to the court for health reasons. The prosecution was forced to hand over this statement within five days.

The court also addressed defence complaints over lack of paperwork. Although she estimated the defence is equipped with materials under the law, she was obliged to specify until March 30th the evidence she claims is missing. After that, the prosecution will have three days to give its stand.

At the end of the session, with proposals by lawyer Jovana Filipovovic, the court made a decision to interrupt today's session. Under that decision, the protection of accused Dusan Maksimovic will be presented on another date, because defence has required additional time for enhanced consultations with the accused.

Similarly, accused Blagoje Spasojevic and Vladimir Tolic said they would be protected in silence. Meanwhile, Dusan Maksimovic agreed with the defence proposal for the statement to be delivered at a future session, after being recognised with all the paperwork and evidence, including the videos.

The court also disclosed that it would take action to enable defence to examine material evidence at the Centre for Pre-prisonment.

A day earlier, at the session on the case of “Banjska”, material evidence has been administered.

The Constitutional Court in Pristina, following special prosecutor Naim Abazi's proposal that the trial continue in absentia, had been addressed to the Supreme Court to ask for an opinion on whether, in the case of “Banjska” judgment could be applied in absentia. But, the Supreme, after reviewing the request “for giving judicial thought to Article 303 par.7 of the Criminal Procedure Code in the case “Banjska”, had clarified that it does not provide legal opinions about dilemmas that have the first degree during the case proceedings.

Thus, the Constitutional Court in Pristina has ruled, with which it has rejected the proposal that the trial of 42 other indictees (41 physical and judicial persons) charged with the terrorist attack at “Banjska” continue in absentia. The court had also indicated that international letter was issued to these defendants and their ban and extradition were expected to develop the procedure against them.

Judicial review hearing against the three accused in the “Banjska” case: Vladimir Tolic, Dusan Maksimovic and Blagoje Spasojevicq, was held on April 17th 2025, in which the three indictees were acquitted. While special prosecutor Naim Abazi, the defense of the accused and the damaged party have given the opening word.

Even in the initial review held on October 9, 2024, the three defendants have been declared innocent.

By contrast, the Constitutional Court in Pristina, the Special Department, with the verdict of December 6, 2024, had refused requests for dropping the indictment and objections to evidence submitted by defenders of the accused against the Special Prosecutor's Act of the Republic of Kosovo.

The Court of Appeals, on March 13th 2025, announced that it has made a verdict, which confirmed the Constitutional Court's decision in Pristina, with which the indictment against the accused was confirmed in the “Bayska” case.

So far, arrested and under detention for this case are: Blagoje Spasojevich, Vladimir Tolich and Dusan Maksimovic, for whom criminal procedures have been isolated.

The Special Prosecution Act charges 44 physical persons and a judicial person “RAD D.O.O.” The list of indictees leads Milan Radojic.

The Special Prosecutor of the Republic of Kosovo (PSRK) on 11 September 2024 has filed charges against Milan Radojic and 44 others for the September 24th 2023 terrorist attack in Zvecan Banjska. The accused are charged that, through the use of heavy-armed violence, they tried to exhumate the northern part of the territory of the Republic of Kosovo and unite the Republic of Serbia, by cerces as a result of the violence used has remained the dead police official, African Bulnjak, and the lives of other police officials and the civilian population were risked.

In Baysnka, Zvecan, in the early hours of September 24, 2023, was killed by Sergeant Africa Bulnjak and two others were injured. Then there were three attackers left, while others had fled for several hours to the Biensca Monastery. Milan Radociq had claimed responsibility for the terrorist attack.
