The Ministry of Environment, Space Planning and Infrastructure (MMPHI) has been fined 3 thousand euros by the Agency for Information and Privatisation (AIP), for failing to offer access to public documents. Concretically, the fine has to do with the tender of the Pristina road, which one of the companies that has offered in this tender has applied for access to the documents of economic operators that have been declared winning the tender.

The ministry had not offered access to the company and the same was directed at it. AIP, as a competent organ in implementing the Law on Access to Public Documents.

On July 21, 2023 The Agency for Information and Privateness had decided on the company's complaint, whereby it obliged the MMPHI to provide the required documents side.

In reasoning with the fine, the Information and Private Agency says that even after the announcement and a consultancy meeting with MMPHI representatives, the latter have not offered access.

And so, MMPHI, according to the fine decision, was argued that documents requested by the company, were also obtained by the Kosovo Police investigator and offering access to them, could harm investigations.

But the AIP had requested a clarification by the Kosovo Police concerning this claim, and the representative of investigations in the Kosovo Police has confirmed that providing documentation presents no problem in the investigation.

“Praising the unwillingness of the public institution to offer the requested approach, according to the July 21st 2023 decision, AIP considers that it has seized all legal procedure opportunities to convince the public institution to live up to the right of the complaining side” citing the decision of the Agency for Information and Privates.

The ministry has a 30-day deadline to pay the fine, on the contrary, the decision is turned into an executive title and is executed legally by the private owner.

And so, MMPHI has the right to file lawsuits for opposition to the competent court, but conducting the indictment does not prevent the execution of the verdict. /Cashho. com
