Investigation procedure launched against Serbian MTS

The authority has analysed the conditions of the competition market, and acting on official duty, has conducted preliminary review of the concentration assessment, concerning the reasonable suspicion that MTS D.O.O., which operates on the respective market, of providing internet and cable services on Kosovo's territory, has realised trading in the respective market, gaining control over other companies, for which the legal obligation for reporting the competition protection law is met.

The authority reports that transactions/commercials if they have been carried out, without handing over the mandatory announcement of the concentration goal under the Law for Protection of Competition, represent the form of restriction or distorting of competition from companies in Kosovo's territory or outside the territory, if their actions affect the Kosovo market.

Control of the unions aims to prevent competition deviations and aims to prevent anticompetitive effects before they occur (ex ante), the announcement further said.

The authority reports that the beginning of the procedure for investigating competition disorder is aimed at clarifying facts and thus proving the alleged violation.

The AKRK will make its merit decision based on proven case facts and will keep the opinion and citizens informed who receive services from the MTS D.O.O. company.
