Because he “had heard voices”, a 37-year-old from Kosovo had beaten his roommate, an 85-year-old man in St. Urban. The victim suffered wounds as severe as he died that night.
The incident occurred on April 14, 2017. The prosecutor of the crime has been tried by Lucerni's criminal court as a guilty (condemnious), broadcasting albinfo.ch. He was ordered to take custody.
But the defence has appealed against the indictment, so the appeals hearing will be held on January 12th at the Lucern Cantonal Court.
Doctors who were on duty that night are considered responsible for the murder. Thus, the indictment for alleged murder by carelessness has been filed against the former leading doctor of Lucron's psychiatric hospital, “St. Urban” and the steward doctor at the time.
The investigation is complete, the prosecutor announced on Monday. Both people have been charged with at least contributing to the patient's murder, as responsible persons and employees of St. Urban.
The criminal indictment for the carelessness of the murder against the assistant doctor at the time rests on the fact that when 37-year-old was admitted to the psychiatrist, serious failures had occurred, the report said.
So says the public prosecutor: Among other things, the investigation should clarify whether serious criminal errors were made when the acute psychic disease had been accepted and assigned to a double room. Had the situation become a more careful assessment, killing a neighbor could have been avoided.
Meanwhile, the steward does not accept a criminal order against him and has opposed him. The process against the former mayor has been interrupted, as no shortcomings have been found in organising the operation of the clinic and human resources.
The two decisions mentioned are not yet final.
