Kosovo story accused of false marriage in Switzerland

The Migration Office has revoted the permit of permanent residence in Switzerland (Viza C) to a Kosovo woman with the suspicion of breaking marriage. But it has successfully resisted the decision before the Administrative Court, writes “Solothurner Zeitung”
Foreign citizens who perform a fig marriage to gain access to the right of residence can be expelled from Switzerland, broadcast albinfo.ch. But even permanent permission of attitude can be revoted to him or to what he has lived in Switzerland for less than 15 years and has provided false information in the process of obtaining permission. The same is true if the person has kept silent on life's circumstances.
At times, though, it is difficult to prove to someone whether he has or has no extinguishing marriage. The administrative court of Lucerni Canton has now raised “pragun” on this issue and has overturned the stance of the 27-year-old cantonal immigration office.
The young woman had emigrated to Switzerland in 2011 as part of the family union after marrying a fellow countryman who had the right to stay in Switzerland (Vise C) broadcast albinfo.ch. However, in March 2012, young mates were separated.
In September 2012, however, the woman had informed the immigration authority that she and her husband had agreed and would live together again. The Cantonal Police, in turn, had announced to the Migration Office that this could be a permanent marriage. Finally, in the spring of 2014, the Migration Office had offered the husband a personal interview.
Output: True, there was evidence that it was a fig marriage, or marriage, that was exclusively bound to obtain a permit to stay, sends albinfo.ch. At that time, however, the immigration office itself had decided that these indicators were not enough and thus extended the permit of the woman.
In 2016, Kosovo finally received a permanent residence permit (Vise C), but with a period of control until September 30, 2020. Less than a year later, the Migration Office had again received an announcement that the marriage between Kosovo and her husband, who had been residents in Switzerland for a long time, had been divorced. Moreover, it seemed that the woman had not lived with her since 2013. Meanwhile, he had borne children with another woman, broadcast albinfo.ch. This situation already seemed like sufficient evidence to authorities, to testify that they were deceived all the time.
In December 2019, the Migration Office revoted women's residence and assigned them a deadline until the end of February 2020 to leave Switzerland.
But the Migration Office will have made <x0hepsamp” without Kosovar “Fighting” and Administrative Court. In that court, the woman filed a complaint, and after that she had won the right, records albinfo.ch. It remains to be seen whether the complainer and her ex-husband had a permanent marriage or not.
Of course, doubts about the immigration office were not to belittled, but the evidence it offered was not enough to witness abuse of a single, formal marriage.
At least the man returned to his wife after his first divorce in 2012. And: The fact that he continued to live a double life later as well as having another child with another partner makes “difficult” blaming the betrayed woman, transmits albinfo.ch. Moreover, further common life after three years of marriage (and this is supposed to have happened in concrete case) is not absolutely necessary for permission of residence.
