In this session it has been clarified that the criminal act of “failing to act according to health provisions during the 148x1> epidemic cannot be considered consumed by the suspect when dealing with violations [...]
In this session it has been clarified that the criminal act of “inaction under health provisions during the 148x1> epidemic cannot be considered consumed by the suspect when it comes to violating the decision in question.
This criminal act can only be considered worn out when it comes to individual decisions that the competent organs authorised by law have issued to any person or group of persons for any concrete measure that he/they do not act”, explained in the Supreme Court's Juridical opinion.

Under the leadership of Supreme Court President Enver Peci, the Supreme Court General Assembly has been held today, in which a majority of votes have been adopted Jurydic Opinion concerning criminal work ʹ inaction under health provisions during the epidemic by Article 250. The KPRK in light of the government's decision of the Republic of Kosovo no. 01-15 on March 23, 2020.
This opinion has been issued following the request of the Constitutional Court in Gjilan, the court, which has accepted several charges by the prosecution concerning violations of the government's decision, which was prohibited the free circulation of citizens.
Thus, through this opinion Jurydical, it has been clarified that the criminal act of “inaction under health provisions during the 148x1> epidemic by Article 250 of the Republic of Kosovo Penal Code cannot be considered consumed by the suspect when it comes to violating the decision in question.
This criminal act can only be considered worn out when it comes to individual decisions that the competent organs authorised by law have issued to any person or group of persons for any concrete measure that he/they do not act”, explained in the Supreme Court's Juridical opinion. During the hearing has also been discussed with the pandemic management, with regard to the cases, Chairman Peci has requested that no situations with the pandemic be misused for lack of employment, but that annual holidays be exploited by judges and support staff.
