The Special Court recently, with the publication of charges against Kosovo President Hashim Thaci and Democratic Party of Kosovo leader Kadri Veselini, has greatly irritated people in Kosovo.
Recognition of justice cases, politicians and activists have found very often that this court is unfair and that the same has unilateral access to the war crimes trial.
So has ombudsman Hilmi Jashari in an interview given to Public Television weeks ago.
Jashari says the effects of Kosovo's Specialised Chambers are not equal. Furthermore, he says it is the weakness of Kosovo's judicial system that has already caused this court to pursue these war crimes.
The “System that was created in the Specialised Chambers and the effects it may have on Kosovo is uneven in relation to the crimes committed in Kosovo. Kosovo is already known to have been protected by international organisations because it is threatened with the destruction of the national being. It is true that we have once had internationally organised judicial system, but have found that there has been no effective judicial system in Kosovo. We have come to the conclusion that there have not been any effective investigations, now a quasi-tribunal will deal with these alleged crimes.”, Jashar said.
The abolition of specials has since begun called for the Association of War Veterans and the Kosovo Liberation Army. Nasim Haradinaj, deputy chairman of this news organisation.net, has indicated there has always been reason for its abolition.
I think the reason for its abolition has always been as if civic will and civic independence existed and they dare use their vote but they are subordinates to their leaders. We tried petitioning, but for the sake of party outrages they didn't vote. We will always work on abolishing or on completing the law and following all laws. The KLA's OVL has repeatedly repeated it, we are not against finding crimes if they are, but we are also about the findings of the crimes Serbia has committed and everyone.”, Haradinaj said.
Furthermore, he has indicated that the KLA's OVL is against the Special Court because he considers it racist and discriminated against, and it also states that Kosovo has granted numerous rights to this court.
We are against the Court because it is racist and discriminated against in our report. If we see only one court like this, it is made for this war and it is made for Kosovo, not Serbia. We have received this right of the Court in the package, it is 10 or 12 people of The Hague tribunal have the right and the power of as much as 2/3 of parliament for changing and fulfilling the provisions of our Constitution that is only the right of our Serbian Parliament”, Haradinaj said.
Haradinaj has also said that the minimum that can happen with this court is to happen to comply with the law, but if that can't happen then the Special should be undone.
“We have also lost the right or given the power of our parliament to a foreign state. The minimum demand to be completed and the law changed, but if this is not done then let it be abolished. It's anachronic, legally anachronic that the 2001-2002 murders cannot be called war killings because there is no war at this time. There was no war after September 1999. ”, he said at last.
And the lawyer accredited by the Special, Tome Gashi, says that Kosovo's Assembly cannot abolish it, nor can it complete or continue the special court mandate.
The deputies of the Kosovo Assembly in 2015, when they have voted the Special Court, have voted to have the competent European Union bodies decide when to finish matters. There's no way, there's no way it's going to go on and off.
Asked about the completion of the Special Law, he says this is not the competence of the Kosovo Assembly.
“could have such initiatives, but changing the law on the Special Court and which is no longer the competence of the Kosovo Assembly is a difficult thing. It depends entirely on the Court when he does his job. So far we have two charges, one was in February, and the other against President Thaci and Mr. Thaci. Wessel.”, Gashi said at the end.
While the Special Court is continuing day after day invitations to former KLA soldiers, Kosovo President Hashim Thaci has been interviewed in Special Prosecutor's Special Chambers near The Hague.
On the other hand, publishing the indictment against Thaci and Wessel has been deemed contrary to all of the Special Court's internal rules and the unprecedented case in legal procedures.
