The Constitutional Court of the Republic of Kosovo has reacted to the president, as well as to the country's prime minister, complaining of pressure on her work.
According to the Court, President Hashim Thaci and Prime Minister Albin Kurti “are trying to influence or prejudge the Constitutional Court's decision on the issue of the president's decree for the appointment of mandate for the creation of the new government”.
The Constitutional Court strongly condemns this intervention in its institutional independence, as well as trying political and institutional acts to include the Constitutional Court in daily political debates”, the Court has said in a response.
The Constitutional Court's full response:
The Constitutional Court is following the threatening public discourse that is taking place in recent days by the incumbent president and prime minister, as well as other bearers of institutional and political functions who, by accusing each other of pressure on the Constitutional Court on the other, are trying to influence or prejudge the Constitutional Court's decision on the matter of the president's decree for the mandate of the new government's creation.
The Constitutional Court strongly condemns this intervention in its institutional independence, as well as trying political and institutional acts to include the Constitutional Court in daily political debates.
The Constitutional Court equally strongly condemns the discussion of individual judges, as persons who have individual authorisation or decision-making responsibilities in the case.
The Constitutional Court recalls it acts as a whole, on the basis of constitutional and legal provisions governing its decision-making.
The Constitutional Court assures the public that it will not be subject to such pressures and threats, and that there is no need for political or public protection from anyone, because the Constitution and the law offer all guarantees necessary to act independently and impartially.
In the end, the Constitutional Court invites all parties in the procedure to refrain from comments and actions intended to influence or prejudge the Constitutional Court's decision in any other case.
