The country's president, Hashim Thaci, has, through an official letter, asked Vetevendosje Movement Chairman for a new name to mandate him as a candidate to form the new Government.
In this letter to Kurti, Thaci has said that following the motion of no confidence in the government (The Parliament decision of the Republic of Kosovo No. 07-V-013, dated 25.03.2020), in accordance with Article 95 of the Constitution of the Republic of Kosovo, will take the necessary steps to appoint the mandate for forming the Government of the Republic of Kosovo.
“Taking into account Article 95 of the Constitution, Constitutional Court's verdict of KO1/03/14, dated July 1, 2014, and the decision of the Central Election Commission to prioritize final results of the Kosovo Republic's Assembly, held on October 6, 2019. 1845-2029, 27.11.2019), the Vetevendosje Movement, is the political subject that has won the majority in the Assembly to form Government and has the right to the new candidate proposal to form Government. Please, on behalf of the Vetevendosje Movement, proposes the new candidate, which I will mandate to form the Government of the Republic of Kosovo”, says in the official letter to President Thaci to Kurti.
Article 95, paragraph 1 mentions the majority gained to form Government, and it appears that this has enabled the President's Office to adapt the constitutional language, although Vetevendosje had gained only a relative majority.
While in a second letter to Albin Kurti, President Thaci has written that yesterday's meeting between them, following the motion of no confidence in the government, has been consultative with him as Vetevendosje Movement Chairman, as leader of the first party according to the final results of the Kosovo Republic's Assembly, held on October 6, 2019.
“has been a meeting of the formal, legal and procedural character, for consultation to assess whether it is in the interest of the political party that you represent the formation of the new government or the distribution of the Assembly”, said President Thaci's clarification.
At the end of this letter, as president of the country, Thaci has said he ensures all that his further steps will be in accordance with the Constitution and relevant legislation in force.
