Claiming that the decision to annul this process was illegal, some of these candidates have been charged with the Pristina Foundation Court's Department of Administrastration Affairs, reports “Justice Vow”.
When more than two weeks have passed since Prime Minister Albulen Haxhiu had made a decision to cancel the swimming exam, the number of lawsuits she leads has gone to five.
Minister Haxhiu, had cancelled this exam with the argument that the process of selecting swimmers from past government, had not had legitimacy, transparency and objective, as according to her, most elected candidates have been party militants and family members.
But with this Justice Ministry decision, candidates who have passed the swimming exam are not being hired, and who are demanding that this decision be annulled.
Among those who have been practicing lawsuits is the Box Star.
Through the indictment exercised on March 3, 2020, which has provided “Justice Trust”, the plaintiff Bocchi is seeking from the Constitutional Court in Pristina to annul the justice ministry's decision, with which he has been unable to settle.
The indictment is said to contain grave violations of legal provisions.
“Immmanded authentication is illegal because of the wrong application of material rights”, said among other things in the Bocs indictment.
Over the claim that he has never been involved in any political party, that there is no member of any political party, and that there is no family or social connection with commission members, Bocshi is demanding from this court that this decision of the Ministry be annulled as illegal.
The plaintiff, along with the indictment, has filed a request for security measures, so that until the establishment of this administrative conflict the execution of this decision is postponed.
The indictment against the Ministry's decision, on March 4th 2020, has also filed suitors Kreshnik Kucusus, who has asked the Constitutional Court in Pristina to annul the decision with which the Ministry of Justice had cancelled the Noceria exam, failing to elect it as a swimmer.
The commandus, through the indictment, is challenging the legality of the Ministry's decision, demanding that the same be annulled, reports the “Justice Vow”.
The plaintiff claims that the reasoning of the decision regarding family or party ties has nothing to do with it.
“Immmanded authentication is illegal, due to the wrong application of material rights”, said among other things in the Singer's indictment.
He has also applied for security measures, so that until this administrative conflict is resolved, execution of this decision is delayed.
In addition to the candidates who were elected, even former Justice Minister Abelard Tahiri had reacted against such a decision by his successor to this government dictatorship, Albula Haxhiu.
Tahiri had, among other things, warned legal action against such a decision.
I'll see you in court”, his former minister Tahiri's reaction had ended.
Otherwise, according to the Justice Ministry's decision, to take February 24th of this year, the testing process for Noteria, announced in April 2019, has been cancelled.
The reason for this decision is said to have violated the first principles with Administrative Guide during the process of giving this exam MD-NR 012019.
According to the decision, this directive envisions that the process develop based on the principle of legitimacy, transparency and objectivity.
The decision is said to have violated the principle of legitimacy, since the swimming exam has not been subjected to all candidates at the same time, causing the exam to last more than one day.
Also, the decision reportedly has produced successful “candidates” with a disturbing number of family, friendly and party ties.
“This process has produced candidates of “successful “in disturbing numbers of family, friendly and party connections, who have been able to exercise the swimmer's profession at the expense of general public interest, and at the expense of the rights of citizens of the Republic of Kosovo”, the decision is said.
A few days after taking office, Justice Minister Albulen Haxhiu, through a news conference, had announced on February 20th that he canceled his swimming exam.
She had said that this process has not had legitimacy, transparency, or targets, as according to her, most candidates have been party militants and family members.
This competition process requires legitimacy, transparency and objective. There was neither legitimacy nor transparency nor objective. In this way, I as justice minister cannot push ahead with this process and most candidates are party militants or family members”, she had said during this conference.
She had said there were after statements of ambassadors as well, that new swimmers cannot be recognised outside Kosovo.
“We have followed statements from friends, such as those of the German ambassador who have warned they cannot be recognised outside Kosovo. There have also been requests from NGOs to return to zero, which is being investigated by the prosecution. All payments paid by candidates who have submitted to this exam will be returned. This decision today is a clear signal that such processes will never be repeated. The competition for the swimming exam will be announced soon, will not delay”, Minister Haxhiu had declared.
Against this test during 2019, there had been numerous reactions, calling it compromised.
In August last year, six civil society organisations had reacted against continuing the process of selecting swimmers, according to the public competition announced by the Ministry of Justice (MD).
According to NGOs, the process in question cannot be postponed, following Prime Minister Ramush Haradinaj's resignation and the compromise of this process in public, adding that it is unacceptable to continue this process.
Through this reaction, these NGOs had asked the Ministry of Justice to review the decision on the public competition of swimmers, turning it to zero to continue with a government that has legitimacy.
