Renowned Kosovo lawyer for raids: Such action is not done after the indictment is confirmed

Lawyer Palushi has said the raid and sequential today at the home of former Kosovo president Hashim Thaci may be related to any new additional investigation into the Special Court's obstruction allegations, until he said the raid and sequentation could take place during the investigation phase and not after the establishment, and confirmation of the charges.

Today specialised chamber investigators have taken action to raid former Kosovo president Hashim Thaci.

The event started early in the morning and ended in the afternoon.

Regarding raids and seizures at the home of former President Thaci, Metro has contacted lawyer Palushi, asking whether such a raid is legal.

According to Palushi, the raid and sequencing can be carried out during the investigation phase and not after the establishment and confirmation of the indictment.

“Bastment and selection can be conducted during the investigation phase, and not after the establishment and confirmation of the indictment. The evidence provided in this way is not acceptable to be used in the trial according to the confirmed indictment. Today's raid and selection may be related to any new additional investigation into the theft allegations of the Special Court and the Special Prosecutor's Office, or about publishing files by War Veterans Organisations in recent months”, Palushi told Metro newspaper.

Metro has also asked the lawyer Palushi whether there are unconstitutional and anti-legal raids on Thaci's house, as well as whether the Penal Procedure Code has been violated.

He said this code is not implemented by the Special Court.

The Criminal Procedure Cod is not implemented by the Special Court. The investigation, the establishment and confirmation of the indictment and trial near this Court are conducted under the Specialised Chambers Law and Specialised Prosecutor's Office and on the basis of Procedure Rules and Evidences of Special Court”, Palushi told Metro.

We remember that the indictments by the Special Court were confirmed yesterday for former President Hashim Thaci and former PDK chairman Kadri Wessel. After confirming the charges, the two are being held in custody at The Hague, where they are expected to be tried.
