The government Hoti could collapse if the Constitutional Court interprets as against the law MP Etem Arifi's vote, which even after the prison sentence had continued to take part in the hearings.
This case, which has been submitted for interpretation nearly six months ago, has not yet received epilogue, until, at the Constitutional Court, they have announced in a response to the Express that public session will be held in this case.
This session, to be held through video conference, will be held by December 2nd.
The court has decided to hold public hearings on this occasion on December 2, 2020, and all parties of interest involved in the subject will soon be notified. Because of the current circumstances under the word "Condavid-19," the hearing session will be organised through video conference, in line with recommendations and guidelines in force of the National Institute of Public Health of Kosovo”, the Constitution says, until the Court on this issue is also addressed by the Venice Commission.
At one time, in view of issues raised in the motion, the Court has also made a decision to address the Venice Commission Forum, in terms of practices and rules that apply to similar situations, in the member states of the Commission”, the Constitution says.
The Constitutional says far from the start there has been continued communication with all institutions and parties involved in the case.
“Based on the constitutional and legal provisions in force, the court has a 60-day deadline for reviewing this requirement, which begins after the surrender of all documents needed for constitutional examination of the subject. In terms of this case, the Court has had continued communication with the institutions and parties involved in the case even during September, with the goal of completing the subject file”, it said in response.
Etem Arifi was one of 61 deputies who voted in favour of electing the Hoti government. For Albin Kurti's party, Vetevendosje, which was ousted by power, the Ashkali Party MP's vote is unvalid for the fact that he has been convicted of corruption with the court's final decision.
That's why the LVV was directed for interpretation in Constitutional. Any decision of this body can bring a new political situation to the country.
