Etem Arifi in prison, deputy chairman of his party casts doubt on reason for arrest

Since last week, Hoti Government has no 61 votes in the Assembly, because MP Eem Arifi from the Ashkali community, whose vote allows the coalition a simple majority, is in prison.
Now the Ashkalin Party for Integration is headed by Deputy Mayor Qazim Canman, currently deputy minister of culture.

Given the Law for Elections, the former President Arifi replaces the second on the list from this party, with more votes. In this case, he is Deputy Minister Candorman, who has already made up his mind.

The procedure under the Law for Elections, Article 112, for replacing an MP, begins at the request of the Assembly to the president, which calls for the name of the Central Election Commission, to follow the Assembly. In April 2018, Etem Arifi was sentenced to two years in prison for fund fraud of 26 thousand euros.
The guilt was proven by Appeals on August 20, 2020, but were lifted nine months of sentence.
Under the Constitution, the MP's mandate ends if the lawmaker is sentenced to one or more years in prison. In spite of the sentence, Arifi voted in two important Assembly sessions, since the court approved the demands, so that, for health reasons, it would not go behind bars.
On March 25th, Arifi cast the pro-missing vote of Kurti Government, and June 3rd, also voted in favour of establishing the Hoti Government. The request for assessing the legality of MP Arifi's voter turnout in those two sessions, while convicted, the Vetevendosje Movement has sent him to the Constitutional Court on 11 June, which has not yet decided on the case.
