EULEX chiefs wanted judges from Eastern Europe easy for political trial

EULEX chiefs during their mission for years prefer judges from Eastern Europe, not judges from Western Europe. This, as they say, is easier to blackmail, since they do not want to lose large salaries, which then leads to taking decisions according to chief instructions, bringing political trials.

A witness has revealed new details of policymaking with justice in this international body.

“Z. Dean and his deputy, Bert Versmessen, have been ridiculed by saying they prefer judges who are contracted by the “states of Eastern Europe” because they were “too afraid not to lose their contracts that were paid fairly well” to make any decision that was not in the interest of the mission. They thought judges from those states could be controlled”, this witness said. “Z. Dean” is Kenneth Deane and he was the EU's envoy for EULEX investigations.

The witness has shown that Dean has been upset because there have not been many sentences by EULEX judges. He blamed Judge Simmons for this. He has thought Judge Simmons had to have more control over EULEX judges and ensure that they condemn more defendants. Mr. Dean has not liked the fact that EULEX judges have had their independence. As mission members he has thought they should work on “interest” of the mission. More than once he repeated the “they don't understand why they're there””, the witness said.

According to him, on two occasions Dean was referring to Judge Simmons' private e-mails. The first “Your first time has been, too, was Bert Versessen and Mr. Dean has said that Judge Darius Sielicki has given investigators his private e-mails to Judge Simmons. I haven't seen the email. However, he said he had seen the e-mails and said they were reports of the evil behaviour of EULEX judges and staff who were sent to the British Foreign Ministry and anti-fraud investigators. Investigators who had private e-mails were Ainrias O Caoimh and Chris Starmans. Mr. Deane has regularly met with those investigators”, the witness said.

According to him, Dean had agreed with investigators that they would not mention e-mails during their corruption or in their report.

“has asked whether a criminal offense was committed to extracting e-mails or whether there were cases for which E EAS (For European Foreign Action service) must be concerned. Mr. Dean said Judge Sielecki made it clear to him as well as to investigators that the emails were illegally taken. Mr. Deane has discussed this with investigators and has agreed with investigators that they will not mention e-mails during the corruption or in their” report, he has indicated.

At one point Dean had called Judge Simmons unfaithful.
The second time private emails were mentioned has been a meeting with Mr. Dean . . . .. He was also present at the meeting. . Mr. Dean said he talked to Kiera Bradley. He said they discussed private emails. In that context he was referring to Judge Simmons that he was <x0nonistic “=x1>. He said Judge Simmons “has suffered” and that he will be sent home. I remember this meeting very well since it was before the commission met and considered claims against Judge Simmons. Mr. Deane has met members of the Kieran Bradley Discipline Commission, Martin Bauer and Stefan Huber, in some cases”, he indicated.
According to the witness, from comments made by Dean and Versmessen it has been clear that they have agreed with the disciplinary Commission on the plan regarding the outcome of the case for disciplinary measures.
The High Representative was personally aware that Judge Simmons' private e-mails were illegally received and were in Mr. Deans and investigators. I have more evidence that I want to give to court”, he indicated.
He said Dean was determined Simmons should be sent home.
“On several occasions I have met him . . . . With Mr. Deanne. She told me that Mr. Dean has been determined to send Judge Simmons home. She was aware that Mr. Dean has met several times with members of the disciplinary commission”, he has said.
“After the Le Monde article, E EAS (SHVJE) has been determined to destroy Judge Simmons' reputation. This has been done for several reasons: first to undermine his credibility over his allegations of bad behavior (indemnity); second to condemn him because of his public and third appearance, as described by one of our colleagues, for “decourager lets autres”. In other words, to discourage other beacons”.
He said Dean was cheating that Simmons was under investigation. November 2017, Mr. Dean has instructed the staff in EULEX to issue the app for media (the platform that Judge Simmons has applied to EULEX). This is done through the EULEX Press Office to “their journalistic associates”. The press official from EEAS has also issued a communique claiming Judge Simmons is under criminal investigation. Mr. Dean knew this was not true. However, the goal of EEAS (SHVJE) at this stage has been to hurt Judge Simmons”, the witness said. “in 2016 and again in 2017, Judge Simmons has pressed charges of violations, including EULEX staff and senior staff of EEAS (SHVJE) including Mr. Dean and Mr. Versmessen. Mr. Dean has appointed Mr. Versmessen is responsible for the investigation. This investigation has never been intended to be an independent investigation. Some of the senior staff have been questioned, failing to refer the case and investigations to an independent team. The high representative has been aware that Mr. Dean and Mr. Versmessen was investigating himself. She has failed to intervene. The EAS concentration has been in limiting the damage by diverting attention from the violations and poor conduct of its staff for the alleged wrongdoing of Judge Simmons”.
According to the witness, this was not the first time Dean had intervened in the investigation. This has not been the first time that Mr. Dean has stepped in on an investigation. In May or early June 2015, during investigations into charges against Francesko Flori, Italy and EULEX Judges Chairman Mr. Deane has traveled to Finland and has met with someone from the Finland Ministry for Foreign Affairs. The purpose of the meeting has been to convince Finland's Government to recall Heike Wendorf, the prosecutor who has led the investigation into Judge Flor. Mr. Dean has been unhappy with the investigation and has not hidden the secret to the fact that he wanted to kill those investigations. He described Mr. Monday as “out of control” I'm told the trip was paid off by the EEAS (SHVJE) budget. This should be controlled”, he said. “.
