A month of house arrest against two police officials for abuse of office

The Special Court in Pristina has ruled regarding the Special Prosecutor's request of the Republic of Kosovo for the appointment of the detention move against indictees R.I. for criminal work Misuse of the official position or authority from Article 414 par.1 of the KKP and against defendants B.G because of the alleged suspicion that he committed criminal work Misuse of the official position or authority from Article 414 par.1 of the KK and criminal work Taking bribes from Article 421 of the KP.1.

The court has taken office and defendants R.I and B.G. have been assigned the measure of house arrest in the duration of 1 (a) month.

According to the Court, there is doubt that the defendant R.I in the quality of the official person, the judge at the Constitutional Court in Mitrovica, and the defendant B.G in the quality of the official person, the police officer in the Kosovo Police, had used the official duty or authority by passing their competencies in order to profit property illegally.

The court has found that the criterion of suspicion based that defendants have carried out conform acts 187/1 under 1.2 points 1.1 over Article 183 par. 1 under 1.1 of the KKPPRK. The court also finds that the criteria from Article 183 par.1 subpar.1.2 concerning Article 187/1 under 1.2.2 of the KKP as a special condition for the appointment of house arrest, since there is reason to believe that defendants can change or forge criminal evidence as well as the risk of influence on the injured and co-particator.

Against this ruling the side is entitled to complaint at the Kosovo Court of Appeals.
