The union considers the decision to be taken contrary to RTK Law, namely Article 3 which says: General Director of the General RTK is named and dismissed by 2/3 of the board members' votes.
The total number of Board members under this law is 11, and the votes needed for the general director's election must be at least seven. While the RTK Board of Directors has by only six votes made the general director's election.
“The SPRTK, calls for the institution you lead to file indictments for the opening of the Administrative Conflict, at the Constitutional Court in Pristina-department on administrative issues, due to the legality of the verdict, date 24.04.2019, of the RTK Board, for the election of the General Director of RTK”, is said to be in their response.
According to the announcement, the Independent Union bases its request on Article 10 points 2 of law No. 03L-202 for administrative conflict, where it says the right to start the administrative conflict has the ombudsman, associations and other organisations, which operate in defense of public interests.
