The Vetevendosje movement, the branch in Kamenica, in June 2013, had filed charges against the Kamenica municipality, claiming that it had not been allowed access to public documents, had not been offered to property rights concerning a plot in the Kamenica municipality, respectively.
According to the decision, provided by “Justice Vow”, it is said that “Vetevendosje” had not filed a complaint against the decision not to allow access to official documents, with which he had not acquired legal means, as envisioned with the Law for Administrative Procedure.
In this case, on October 15, 2019, the session had failed, as Vetevendosje Movement Chairman Bajram Mavriqi had demanded that the hearing be postponed.
This reason that he was not prepared for holding the session, with the request that at the next session this indictment be represented by any lawyer of this movement.
He had also stated that the indictment was exercised in the name of “Vetevendosje”, by his former colleague, Brikeen Ramabaja, so, according to him, it should be announced what the legal interest in continuing this procedure is.
But, although he had demanded that this session be postponed, at the session, held on November 20, 2019, no one had represented the “Movement Vetevendosje”.
By contrast, on June 21, 2013, “Determination” had exercised indictments against the Kamenica municipality, seeking from the Constitutional Court in Kamenica to impose the indictee to provide the data regarding ownership over two sections.
But, the Constitutional Court in Kamenica had been declared not competent and the case had been delegated to the Department for Administrative Affairs of the Foundation Court in Pristina.
Through the indictment, “Determination” claimed that he was denied access to public documents, with the reasoning that one of the basic property principles is publicity, meaning that everyone has a right to know who is the title of ownership over the particular item.
By this, the plaintiff claimed he was illegally denied access to public documents.
