Former EULEX prosecutor Maria Bamieh has said her statement, given how EULEX had sent all cases of Serbian war crimes to Kosovo to be investigated in Serbia, is correct.
“I was asked about that statement I gave in an earlier RTK programme when I had shown that EULEX had sent all cases of Serbian war crimes to be investigated in Serbia. That's right. I don't know the numbers and names of cases, but I know that all cases that had a Serbian suspect had returned to Serbia. And the reason given was that the suspects were in Serbia and that Serbia would not extradite them, so the only way such cases could be investigated was to return to Serbia for investigations. I don't think that was necessarily accurate”, she said, for RTK.
“has had the opportunity to seek alternative routes, so that these cases could be handled in a neutral jurisdiction, to ensure a kind of co-operation from Serbia, to allow the suspects to be tried for crimes they committed to”.
But it does not suggest that these cases have never been investigated.
I have found that a series of cases involving Serb victims were examined by the College EULEX for Human Rights, they told him EULEX investigated these cases. None of these cases were investigated. This seems to be a serious neglect of the task. It is essentially wrong, contrary to any principle of natural justice. Even victims have the right to a fair trial. Even the people of Kosovo have the right to expect EULEX to provide judicial processes that are fair and without political interference. Just, that didn't happen”, she said.
EULEX mission prosecutor Maria Bamieh had accused her colleagues of taking bribes, which cost her dismissal.
