The Independent Supervisor Council for Civil Service is an independent constitutional institution, but not all institutions respect its decisions.
It is the fourth month this institution is trying to get the Ministry of Infrastructure to respect the decision to cancel the competition for deputy financial director at the Air Navigation Agency, KTV reports.
This decision, for the position that Ramush Haradinaj's former assistant, Preservation Selamaj, had taken over after failing to understand whether he had met the criteria for this position.
But the Law for the Council imposes public institutions that members of the Council are present during the employment competition.
IKD Director Ehat Miftaraj has said that this case shows how institutions in Kosovo operate, which implement political and non-legal directives.
The council has announced Kosovo's Parliament and Government of the Ministry's disregard for the institution.
In the Kosovo Assembly, however, they have said they are considering the case.
“The Assembly is awaiting the depletion of procedures by other responsible institutions, conform Article 23 of the Law for the Independent Council for the Kosovo Civil Service”, it says in a written response to this institution.
But, provisions 6 and 7 of this provision of the Civil Service Council law give the Speaker of the Parliament competency authority to ask the prime minister to take all actions for the immediate implementation of the Council's decision.
However, the law allows the parties to initiate the procedure for completing the Council's decision to the competent court.
But even if the Ministry of Infrastructure has exercised indictments for Administrative Conflict, as stated, Paul Lekaj, the Council's decision has had to be implemented.
This is imposed on Article 22 of the Law for the Civil Service Council, which also stresses that the decisions of this institution are of strict shape.
These decisions must be implemented within the 15th day of accession, which in the case of ASHNA deputy director has had to be implemented as of October 20th 2018.
In addition, the law explains that failure to implement the Council's decision by the institution's responsible person presents serious violations of the work duties. /Time.net
