The Kosovo Lawyers' Oda and lawyers will enter the general boycott tomorrow, for all courts, prosecutors and police on the entire territory of Kosovo. This decision is expected to be valid until the withdrawal of the ordinance and recommendation from the Kosovo Judicial Council (KGJK) that prohibits access to the facilities of justice institutions.
The OAK Steering Council, dated 05.01.2019, unanimously praised that the Constitutional Court's Order in Prizren of the 08.08.2018 and the KDR recommendation of the 27.12.2018 represent fundamental violations of the principle of access to justice and as such are unacceptable.
The Steering Council has demanded that the Order and Recommission be withdrawn later on date 08.01.2019, but after the KDR has so far made no withdrawal, then the OAK has decided to boycott the general, saying that attorneys' unwillingness will have no legal consequences for lawyers and parties.
All had started in August last year, when the chairman of the Prizren Foundation Court, Ymer Hoxha, had ordered the provision not to allow the introduction of lawyers and parties without permission or oral permission from the judge or the court's president.
A similar order, Hoxha had brought upon him the troubles a lawyer had brought upon him. Having been estimated that the order was in accordance with the arrangement for internal organisation of courts, the Council had recommended it to other courts.
But, the Prizren case, according to Oda of Lawyers Chairman Osman Havolli, should not be taken as a cause for including all the country's courts. /Periscopi
