According to KDI, two months is the regular deadline the Parliament has available to give final approval to this bill since it was brought to the Government Assembly.
The government prosecuted the budget bill on October 31st, 2018, but the bill has been adopted in principle in the Assembly by December 21st 2018. Since the Assembly has failed to approve the Budget Bill by the end of December as envisioned with the Public Finance Management Law and its considerations have been postponed for January 2019. In this case, the Assembly has been binding on the Public Finance Management Law, on the basis of Article 24.2, to make a decision to extend the Early Budget Law for January 2019. And if the Assembly failed to approve the 2019 Budget Bill for the Year in January, then the Assembly would have to make a decision again to extend the preliminary law for February. The lack of such a decision on the part of the Assembly makes any payment and spending of any budgetary organisation during January based on the Public Finance Management Law (neni 24.3). This means that no civil servant or contracting company from any budget organisation can be paid, nor can any budgetary spending be carried out, unless there is a decision by the Assembly authorising the extension of the Pre-Falling Law for January. It is important to note that in the event of the extension of this year's Business Divisions Law for the first three months of the current year, the budget that can be spent for these months is 1/12 part of last year's budget spent at the same time. In addition, on January 21st of this year, the Commission for Business and Finance has held closed public meetings for the second edition of the Budget Bill for 2019, where amendments to the functional commission and other commissions to the bill would have to be voted. On the basis of the Labour Rule, Article 65.1 commission meetings should be open except for some cases specified in this article, and none of them corresponds to the point discussed at this meeting, the one for the second review of the Constitutional Bill”, said in the communiqué.
KDI says it is extremely important that the adoption of the draft budget be done within the set deadlines of the above law, so KDI requires that these deadlines be respected and that this bill is subject to parliamentary debate and necessary consultations with the public, as well as to ensure full transparency during this process.
