The prosecution allegedly did not investigate Valbona's complaints of sexual rape from her husband

A research has revealed new claims on the way the state prosecution had addressed the complaints of Valbona Noecaj to the woman who was killed on the evening of August 7th with her daughter.
Callo. com has found Valbona had complained in May of this year at the Gjakova prosecution, claiming that her husband had even sexually violated her during their lifetime. As her statement is taught, it is not part of a slide of the indictment in which Peter Noecaj is accused of physical injury.

Valbona Noecaj and her 9-year-old daughter were shot dead on the evening of August 7th, while the suspect is Peter Noecaj, the victim's former husband. However, the violence in this family was also reported in May of this year by Valbona Noecaj, who later had filed charges against Peter Noecaj of slight bodily injury.

Kallxo has secured the indictment that charges Peter Noecaj with slight bodily injury to Valbona Noecaj, his ex-wife. This act had been represented by prosecutor Mone Syla. In this regard, Peter Noecaj had pronounced the detention measure for a month.

In the statement given to the prosecutor, described in this indictment, Valbona Noecaj had declared that her husband had committed violence with her.

He's always wanted to have sex with me regardless of whether I'm sick, whether I'm willing, whether I want to or not, I was forced to submit his request for relations even when I opposed him, he had committed this process against me violently”, had declared victim Valbona Nocaj to the prosecutor.

But, call me. com notes that nowhere in the indictment is the description of whether the case prosecutor, Mone Syla, had taken any action to investigate this statement of Valbona Noecaj.

With an official call. com has asked the State Prosecutor's Office not to investigate this statement by victim Valbona Noecaj from prosecutor Moe Syla.

Callo. com has received a report by the chief state prosecutor's office, in which information concerning the failure of the victim's statement, Valbona Noecaj, by the prosecutor of the case was reportedly correct.

I've announced to you that today I've accepted the letters of the Founding Prosecutor's Class in Gjakova, against defendants Peter Noecaj, and after their sight, we have found that the data provided by you through email to be completely correct”, reported in the response of prosecutor Besim Kelmendi from the State Chief Office.

According to prosecutor Besim Kelmendi's announcement, the State Chief Prosecutor's Office will inform the Prosecutor's Council, either for assessment of the prosecution's performance in this case.

In this case, we will also announce the Kosovo Prosecutorial Council Unit for the assessment of the prosecution's performance”, said prosecutor Besim Kelmendi's response.

Furthermore, Besim Kelmendi has announced that in this case they have asked prosecutor Moë Syla to consider the possibility of changing the indictment against defendants Peter Noecaj.

“I announce that our office has asked the prosecutor of the case to consider all legal opportunities so that, during the trial, the indictment filed against defendants Peter Noecaj” is said to change in response to the Office of the Chief State Prosecutor.

Callo. com has also contacted the prosecutor of the case, Moè Syla, who has claimed to be aware of Valbona Noecaj's statement of sexual relations committed by the victim's former husband, but that according to her, there is no expert who would prove that.

What expert in the world can confirm an expertise of sexual violence when she claimed that her husband had had violent relations for 16 years, but never has a market of time or manner, and has not filed the case, but only that there are times after marriage”, prosecutor Moe Syla stated.

According to the prosecutor, because of the inability to prove, she has not taken any additional action to investigate the victim's claim, Valbona Noecaj, of sexual relations with violence committed against her by former husband Peter Nocaj.

Prosecutor Moke Syla further stated that as a prosecutor, she deals with all domestic violence as a priority and that she has handled the case carefully.

“All domestic violence classes, not just this case, I address them as priorities”, prosecutor Mone Syla was declared.

Valbona Noecaj was shot dead on the evening of August 7th five hours earlier, she had notified police of threats being made to him by the former husband. The police inspector is investigating whether the police had effectively protected the victim.
