The accused Laurel Maliqi has pleaded guilty to the murder of her daughter, but has not accepted the qualifications of the work as a serious murder.
Maliqi has appeared before the tribunal today at the initial review hearing before Judge Shacir Zika, who informed the accused of her rights, and explained that admitting guilt would be taken as a extenuating circumstance.
It is in custody from 22 March this year and is being charged by the Constitutional Prosecutor in Gjakova for serious murder.
Prosecutor Agron Matjan in his address said the indictment has sufficient evidence that the accused has deprived her child of life, Arjona Maliqi.
He said a neuropsytricatrist is needed for the defendant's psychiatric evaluation, since the same has claimed her baby's life. He said the prosecution will be declared regarding the qualifications of the criminal act to assess doctors.
The defendant's lawyer, Afrem Radoniqi, said he partly objects to the indictment over the legal qualifications of criminal acts and that opposition would do so in written form, as well as objections related to the assessment of evidence.
The prosecutor suggests to the court that the detention measure be continued against the accused, as there are still legal reasons for continuing the measure because the danger of its escape exists.
Lawyer Radonic rejected the prosecution's proposed detention, arguing that the criminal act was accepted by the accused and that the accused has a minor child and “is concerned about the supervision of this child”.
The lawyer asked the court for his client to appoint another softer move such as domestic arrest.
Judge Zika announced the parties could present their objections and that regarding continuing detention of the accused, he would take a special decision.
According to the indictment, allegedly indicted on 22 March this year at one of the remaining military barracks in Gjakova has deprived her newborn child of life.
Always in accordance with the indictment of defendant Laurest Maliqi on March 21st 2018 was lying at the Regional Hospital “Isa Grezda” in the Gjakova Gynecology Department, where Arjona Maliqi was born now.
On the next day, after she was released from the hospital, she had gone to one of the rooms in the barracks, where she had dug a hole, wrapped her body in blankets, and covered the baby's body with a stone and a concrete piece, causing fatal injuries.
These acts allegedly committed the criminal offense of the serious murder.
