Smakqi, who is also director of legal cases in the Kosovo Post, envisions 3 thousand and 500 of Telekom workers' indictments if their salaries are reduced.
After the financial crisis Telekom has suffered recently, Economic Development Minister Valdrin Luka had declared that the salaries of the workers of this company are dealt with.
Luka had recently reported that the average salary in Telekom is about 980 euros, but in the latest report it is said to be about 1,000 euros to 1,000 euros and 150 euros and that reconstructions must be made, as without them Telekom is inexplicable.
These statements were not well received by Smakqi, who in a Facebook status cited the laws to the minister, who, according to him, prohibits interference in company salaries.
Besides that Public Enterprise Law doesn't allow the shareholder/government to interfere with NP operational issues such as wages, even according to legal acts see the Cohortative Governance Code that M has approved ZHE in Besim Beqe's mandate, nor is the Board of Directors themselves allowed to interfere with the chief executive in determining staff salaries, except for Article 21 of LNP High Officials, the Labour Law also strongly protects regular employment contracts, even in case of NP re-organization (point 17 of Labour Law)”, Smaqi wrote.
He also mentioned other options that he said could save the telecom from bankruptcy.
There are many other options, such as central bank lending or Trust returns according to reports, bank loans or and over-recording in monthly revenues, but to be managed carefully. But and development projects in products and increased quality of services and increased consumer care in fixed waves and telephones and IPTTV”, he concluded.
