The Kosovo Women's Network has reacted to the president's decision on one of the pardoned cases.
By April 23rd, the president of the Republic of Kosovo, Mr. Hashim Thaci took advantage of the right to forgive from keeping prison sentences, right in line with the Constitution of the Republic of Kosovo and with the Law for Forgiveness, Periscopi reports.
Among those pardoned, the president also forgave one of his acquaintances, the son-in-law of his uncle, who in 2008 committed two murders. Among those killed was his 15-year-old daughter and their cousin, aged 21.
The Law for Forgiveness of the Republic of Kosovo, at Article 5, says that “circumstances that can be considered during the apology include, but are not limited to the burden of crime; the risk of recifiism; genuine repentance; and the display of respectful behavior and character”. Given that, the Kosovo Women's Network raises concern about what criteria have been taken on the basis of forgiveness from keeping the prison sentences of this person. In local media, it is said that after the initial six-month sentence, in the case of his daughter's murder, the same one has been released, and that same day, he had also exercised the second murder. In this case, there is no evidence that there are signs of genuine repentance, and the same could be considered a risk of genocide based on his past”, it is said in response.
Furthermore, RGK has said that even the fact that the President and the Forgiver have family ties also presents a concern, as this may be a discouraging message to prisoners and prisoners, but also to all society.
The Kosovo Women's Framework believes in providing opportunities for each individual to progress, rehabilitate and receive proper treatment, in line with laws in the country. RGK considers it positive that citizens and citizens who committed any offense are given access to forgiveness from holding prison sentences, as the Constitution and the Law for Forgiveness provides. However, even in such cases, we need to be alert to what cases we are forgiving them, and what message we are sending to society with these pardons” is said in the RGK's reaction.
RGK has said that in the past it has visited the corrective institutions, where it has seen cases of women who in self-defense have killed family members.
Even though there are cases and facts of torture that these women have experienced over the years as a result of domestic violence against them, this fact has not been taken into account as a extenuating circumstance on the part of the judiciary, and the same women have been convicted of murder in prison for up to 30 years. So we are concerned that in this case, the pardon exercised as the president's right has not respected the institution of forgiveness as the institution defined according to Kosovo law”. /Periscope.
