Charged for killing his wife in 2011, Ferizaj businessman Qamil Hetemi decided to be silent in his judgment for the fourth time.
At today's session held at the Prizren Court, the super-expertosis made at the Federal Entin of Criminalistics, the Office of Criminal Technique, in Vienna, Austria.
After reading statements on all sides, and managing all evidence, when it came to the accused's turn to provide his defense, the same used the right to defend in silence.
According to Mexhit Syla, the lawyer of the accused Hetemi, his client decided to be quietly protected because in this case he has granted 3 times his defense, without even considering the statement in the police and sometimes in the prosecutor, KALLXO.com reports.
Under such circumstances without further questions about the accused, the January 17th was assigned to give the final word, and after eventually two or three days the court's decision will be announced.
Qamil Hetemi is accused of having shot the same gun in the vicinity after disagreements with his wife in September 2011, causing him to die.
While the accused and his defenders, lawyer Mexhit Syla and Rexhep Hasani, claim the deceased has committed suicide.
The principal Witness in this case is the daughter of the deceased and the accused, who advocates the view that her mother has committed suicide.
The judgment of this case is taking place for the fourth time, reports Kallox.com.
So Qamil Hetem had filed an indictment in the summer of 2012, for the criminal murder and possession without permission, while at the June 17th 2013 trial hearing, the prosecution had changed the indictment as far as point 1, so Hetem accused him of criminal murder.
Ferizaj's foundation court had twice found Qamil Hetem guilty and Prizren's Constitutional Court once for the criminal murder. By 3 times the same man had been sentenced to prison for 14 years.
In all three cases the Court of Appeals has turned the case into retrial.
After Ferizaj's founding court had originally been tried and retriald in both cases had convicted accused Qamil Hetemi of killing his wife. In both cases the Court of Appeals had turned the case into retrial.
For the third trial, the Court of Appeals had instructed the changing court, so in the absence of a court trial at the Constitutional Court in Ferizaj, the Court of Appeals had held the Constitutional Court in Prizren responsible for maintaining judicial considerations.
In February 2016, the Prizren Foundation Court accused Qamil Hetem had found him guilty and had sentenced him to 14 years in prison for killing his wife, Ardiana Hetemi. The announcement of the act was made by the chairman of the court, Skender Chocaj.
But in August 2016, the Court of Appeals had ruled for the retrial of the case, reports www.kallxo.com.
The appeal had marred the Constitutional Court's act in Prizren, arguing it contained essential violations of the criminal procedure's provisions, that there is a contradiction between the reasoning and the writing of the subject, and that the actual state has not been fully proved.
The panel, consisting of judges, Majrem Memaj, Fillim Skoro and Have Haliti, had estimated that no counterinference in testimony to witnesses and experts was averted.
The Court of Appeals had also found that there is a contradiction among experts as to traces of gunpowder found in the defendant's hand.
In June 2017, Qamil Hetemi after 5 years of stay in custody has been freed from this measure.
This was because the subject would be sent to the state of Austria for super-expertitis at the Federal Entin of Criminalistics, the Office of Criminal Technique, in Vienna City, with the proposal of prosecutor of the Mehdi Sefa case.
Since that date until today no judicial review has been held pending the expertise report, Kalxo.com reports.
