Pristina Constitutional Prosecutor Ibrahim Berisha, for instance, said that if a warning is made not to offer emergency health services will analyse the situation and investigate whether there are elements of the criminal act.
“Don't provide medical assistance is a criminal offense, strike is allowed as a guaranteed right, but I don't know how to do something like that without handling emergency cases. We will analyse all possibilities and see what will happen, otherwise we will investigate unless the cases of emergency nature are addressed”, prosecutor Berisha said.
The Republic of Kosovo Penal Code in Article 261 stipulates prison sentences for failing to offer medical assistance.
“The doctor, or other health worker, who in opposition to his duty refuses to offer medical assistance to the person who needs such help, although he is aware or should be aware that such inaction may result in severe bodily injury or severe health injury or death, is sentenced to imprisonment by (3)x1>, the Criminal Code defines.
If no medical treatment is met with severe injury or serious health damage, the sentence of between 3 months and 3 years is handed down, while when aid is not offered is fatal, the chief is sentenced to prison sentences of up to 8 years.
In addition, the Law on Greva in Kosovo -- the law that regulates conditions, the way and the right to strike -- envisions cases when minimum labour safety is required.
