The mother of two killed in court: I saw the blood of the boys on Mount Panja.

The mother of the victims has given this statement at Thursday's session at the Constitutional Court in Pec, where the defendant Binak Panja is accused of killing Edsim and Ramiz Berisha.

Panja is accused of committing the criminal offence to the Ramiz Berisha brothers and Arsim Berisha, on July 21st last year, in the town of Kosuriq village of Peja, reports “Justice bet”.

The victims' mother has confessed to the case, where she said that on the critical night her two sons, Edsim and Ramiz, along with Jethlir Gashi, had gone to the mountain to cut wood.

My children and Jethlir have gone to our mountain to cut wood, they've gone with two carats on”, she has declared, saying that later on the case, Jethlir Gashi, who had told him that someone had shot them.

When she heard about the story from Jethlir Gashi, she said she had gone to the mountain with her brother-in-law, Shkelzen.

I went with Shkelzen, brother-in-law to the mountain where the event happened, and there I saw the blood on Mount Panjat. From the mountain I went to the Panjat House and there was neither Binak nor Vallon, but it was just out of Xhavit Panja and I asked where you left me the boys”, she said.

According to Berisha, her sons had never cut off the Panja family mountain, but according to her, they had only gone down to their mountain, passing through the mountain of “Pangjat”.

She has said that in the murder of her sons, it was not only now the accused, but other people, because, according to her, after the killing of the two victims had dragged 60 meters to hide the crime evidence.

She has declined to answer the questions of accused Binak Panja, lawyer Osman Cukovic.

Otherwise, at the session, held on September 24, 2018, Shake Berisha had sought exemption from the chairman of the court, Sami Shardaku, demanding that a woman judge judge be tried, but such a request was rejected on the part of the head of the Constitutional Court in Pec.

Also, at Thursday's session, the parties in the procedure have given their opening words.

Prosecutor Agron Galani, in his opening remarks, has stressed that the guiltyness of defendant Binak Panja will be argued in the main review, following the administration of material evidence and testimony of witnesses proposed in the indictment.

However, on the other hand, the defendant's defender, lawyer Osman Cukovic, has rejected the indictment as unsupportable and unfounded.

According to him, the indictment is based on statements by former defendants Xhav and Valon Panja, who for the same criminal act, had closed the investigation.

“How is it possible for an indictment to be filed on the basis of former suspects' statements and now called as witnesses”, the lawyer has stated, demanding that the former defendants' statements be singled out by the subject papers.

However, such a proposal has been rejected by the chairman of the court, Sami Shardaku.

The next session will continue tomorrow, December 14, 2018, at 10:00, where it will be heard as a witness, Xhavit Panja.

Otherwise, at the initial session of August 17th 2018, Binak Panja was declared innocent in connection with the charge charged.

According to the indictment, filed on 13 August 2017, by the Constitutional Prosecutor in Pec, Binak Panja is charged that on July 21st 2017, around 21:30, in the village forest of Kosuriq, the now deceased, the Ramiz Berisha brothers and Arsim Berisha.

The indictment describes that until the critical moment as a result of disagreements over cutting the forest - the property of the defendant's family.

As reported in the indictment, at 9: 00 a.m., now the late Ramiz brothers and Arsim Berisha, along with witness Jethlir Gashi, had set sail with two horse chariots to cut wood in the defendant's forest.

“leaves the carts with horses on the side of the road, and witness Jethlir along with Ramiz entered the forest and after not noticing anything, Ramisi tells Jetlir go get the horse with the cart along with Edim and start cutting”, said in the indictment.

According to the indictment, after the witness Gashi was on his way to call the deceased now, he heard him talking to someone.

At that moment, according to the indictment, defendant Binak Panja with automatic weapons fired three bullets, and Arsim Berisha heads towards his brother Ramiz Berisha, and again the accused exclusively fires in their direction, robbing the deceased now of life and then dragging their troops out of the forest, drawing approximately 61m from the site of the event.
