It was the largest international organization ( INTERPOL, which removed Haradinaj's warrant and 17 other people.
But for this, Serbia's Ministry of Justice and State had filed a complaint against the INTERPOL decision that the first of Kosovo executives be issued again, the warrant is issued.
Kosovo lawyer Tome Gashi has indicated whether Serbia's complaint is legal. According to him, INTERPOL's decisions are final.
“INTERPOL decisions are final decisions and Serbia only formally enough to calm its opinion has submitted this complaint, while INTERPOL-I will never change its decision. All of the warrants that have been known to be ex-military and KLA commanders have been able to be removed since 1999, if our officials had been of the will, or by exercising pressure at the time in UNMIKU, then these could have been removed even by putting pressure on international communities, but until someone hadn't had any personal problems, nor was he interested in this matter”, Gashi was expressed to “Indexline”
Furthermore, he says nearly all prime ministers have been banned from Serbia's warrants. Gashi points to cases of how they were detained in the quality of executive Hashim Thaci, Agim Ceku and Ramush Haradinaj.
Kosovo's “Opinion mostly concerns the recent arrest case of Mr. Ramush Haradinaj in France last year. But you know almost all prime ministers have been stopped for designated locations due to the international arrest talks Serbia has issued against them. It was stopped Mr. Hashim Thaci in Hungary with the same warrants in the prime minister's quality, then twice has Mr. Agim Ceku, where also in the prime minister's quality the post he has exercised for a while, then Ramush Haradinaj has stopped twice, once in Slovenia for several hours, and then for a relatively long time in France. It means that these INTERPOL decisions are final and that they cannot be returned to the INTERPOL list anymore to be banned by any country, which is a member of the INTERPOL organisation”, he further said.
On the other hand, Kosovo lawyer has added that if Serbia finds evidence of any KLA commander involved in serious war crimes, then the same could present themselves to foreign missions in Kosovo.
According to him, they can do so with the argument that the chief state prosecutor is Albanian.
“Well, Kosovo would now have to identify all the others not only these 18 persons for whom the papers were removed, but as far as I know there are hundreds more that should be required for all to remove warrants issued by Serbia specifically by other states. From 1999 to today in terms of rule of law, we've always actually had foreign institutions, before. UNMIK now EULEX and whether Serbia has evidence for any KLA soldier or commander who is involved in serious war crimes freely send them to EULEX and will be reviewed. These can be done if they don't like Mr. Alexander Lumez as chief state prosecutor only because he is Albanian, then Alexander Lumez, whom Serbia can bypass and send freely to the EULEX mission and they will be considered”, Gashi has said.
In the end, he has even mentioned one of Ramush Haradinaj's soldiers, who, due to the Serbian warrant, suffered for no reason several years in prison.
Gashi believes the list of 18 people removed from INTERPOL will be added. According to him, only the last time there were over 150 people.
The last “has been about 160 people who have behind international warrants from Serbia. And for now INTERPOL has decided to remove these 18 names that were made public. Surely there are many others, and Kosovo authorities must use the same procedure as they have called for Ramush Haradinaj and 17 others for the name of all Albanians who cited from Serbia to be removed their papers. You know that Mr. Anton Leka, who served 13 years in prison in Serbia and he was released a few months ago, he was with a banned Serbian warrant in Montenegro transferred as a former soldier. The KLA, and for no reason, was sentenced to 13 years in prison, which it held and released several months ago. For Anton no one is highlighted even though he was one of Mr. Ramush Haradinaj”, he is finished.
