Since coming to the head of the Kosovo government, Ramush Haradinaj has opened the doors to suspect, accused of organised crime.
Among them, Mehmet Pristina accused of organised crime, and delivered money. Pristina, among other things, is accused of being presented as a false ancestor of Hasan Pristina, with no blood connection.
Prime Minister Haradinaj has waited in his Pristina office on 14 October this year. It is not known what quality he expected of him or what he was discussed at the meeting.
Insander has asked the prime minister's office why he met with Mehmet Pristina, but has not received answers to the issue. The prime minister's office has not responded to whether any guest verifications are made prior to the meeting with Haradinaj.
The meeting with Haradinaj, Pristina itself, has made it public in an Instagram post, publishing photos of the meeting as well.
Pristina is accused of dealing with 36 hectare of state land in Pristina. It is under way in the judiciary along with dozens of others.
Insander had long reported on how over 36 hectares of state illegally replaced land had ended up owned by a group of businessmen and individuals, some of whom are linked to the Democratic Party of Kosovo.
These lands, which lie in Caglavica after being adopted through fraud and illegal judicial decisions, have been bought by new owners at prices ranging from 36 cents to 10 euros per square metre.
The highest price for a field of land has gone up to 1,000 euros, until real prices in that section range from 10,000 to 20,000 euros per field.
The incident, set up several months ago, concerns organised crime, abuse of office, money laundering, illegal reporting of judicial decisions, counterfeiting official documents.
The online newspaper Insander had secured the 120-page indictment filed by the prosecutor EULEX, Danilo Ceccarelli.
At the helm of the accused is former Pristina Municipal Court Judge Nexharije Hoti, followed by businessman Mehmet Pristina and Dukagjin Emerlah.
The accused is Reshat Fetah, head of the legal department at the Kosovo Privatisation Agency, Gani Ademi Ademi émemi égé at the legal department in the AKP, Avni Maxhuni -avka, Isak Ademi nonsun, Albanian Maxhuni, Arton Via, Baytush Zhugoli, Dalip Ibrahim, Jevori, Jabir Kayazi, Albion Maloku, Lirem Zelma, Agim Jerez, Rama, Basri Beka, Erkari, Eramni Ferzi, Ferzi, Ferzi, Ferhmi, Bajrami, Gasram.
According to the indictment, Dukagjit Emerlah had indicted AKP seeking ownership for 11 hectare of land that it rented from the “company KBI Kosova Export” The Special Chamber had dismissed the indictment and the claim of ownership. Emerlah had filed suit at the Municipal Court.
Judge Najariye Hoti, contrary to the law, had recognized his ownership of 36 acres [36 ha], not 11 of his claim. Based on the indictment, the group named a criminal had seen to it that the AKP lost the complaint deadline. The indictment had been sent to an AKP official allegedly controlled by Mehmet Pristina. The ballot was sealed with the AKP's false seal. When the AKP had complained that there was no bias, the group had presented the paper with a fake stamp, claiming the AKP has made the Court's decision but has not filed a complaint.
Thus, the court has taken a definite form. Meanwhile, state land has been sold at ridiculous prices.
Former Judge Nexharije Hoti is accused of having the primary weight of this state land being thus replaced. Thanks to a plea her land was carried to the private owner. The judge had even ruled beyond the plaintiff's indictment, Dukagjin Emerlah. He had demanded only 11 hectares of “soil KBI Kosova Export” that he rented. Without his request, the judge is accused of giving him 36.45 hectare by illegal verdict.
This action is accused of committing the criminal offence of illegal judicial decisions.
The decision to benefit members of the criminal group and deliberately cause damage to the Republic of Kosovo represented by the social enterprise “KBI Kosova Export” and the Kosovo Privatisation Agency, the defendant has issued an illegal verdict on September 27th 2010, with which the suit of the plaintiff Dukagjin Emerlah” is approved, the indictment reportedly in the indictment.
Emerlah is accused of acting as a associate of Mehmet Pristina for property rights of over 45 sections with an area of 36.45 hectares that have been in their own possession by rent.
The prosecution says the indictment has been contrary to the Juridicaovica principle because for the same case it had already established the UNMIK Special Chamber on November 30th 2009 through an act of strict form that has been legally and without a right to complaint.
It has been determined that the plaintiff, Dukagjit Emerlah, had neither property rights nor the right to permanent use of the earth.
But Judge Hoti has acknowledged Dukagji Emerlah as the plaintiff, what has been contrary to the fundamental principles of the Civil Procedure Code, because it has not been a contracting party in power in which the indictment was based and which is linked to 8 October 2004 among the social company “KBI Kosova-Export” and company “Agrini DTV”.
“So Dukagjin Emerlah could not be a legitimate party”, the prosecution says.
The judge had decided, in addition to favouring God's name, based on the indictment, to exclude a contender from a 35 hectares of property.
The judge has not allowed members of the Lazic family represented by Predrag Lazic to intervene as the plaintiff, though they have had limited interest as owners of the 3.5-hectar plots involved.
“During the session held on September 27, 2010, it has rejected their intervention and ruled them out from the case in opposition to the Law on Conflicting Procedure”.
The trial was also taken after the indicted AKP rejected a previous verdict by Judge Nexharije Hoti, with whom security measures were pronounced and opposed its competence, while decisions on that request were still pending. “Concretically, the AKP has filed complaints on the date 14,09.2010 against the 1607.2012 act of decision with which security measures were pronounced against 51 cadastral bumps of 38 hectares and requested in 15. 09. 2010 for the Special Chamber to take over this” subject, the prosecution charges.
By its bias, the judge has illegally proved that the plaintiff, tenant Dukagji Emerundu has had property rights over a social land without ignoring the fact that this contract has allowed him only temporary use of land rented, but not even ownership or the right to permanent use it as the Special Chamber had already established on November 30th 2006.
“in the indictment has been illegally proven carrying social land in behalf of plaintiff Dukagjin Emerlah and contrary to UNMIK's regulations for the Kosovo Privatisation Agency and the law on real estate circulation”, the indictment said.
It is also claimed that illegal property rights have been granted to the plaintiff Dukagjin Emer God on an area of 36. 45 hectares of social land, despite the fact that it has required ownership of only 11 hectares listed in the rent contract. So the act is )ultra petita ʹ contrary to the basic principle of the Law for Conflicting Procedure”.
Mehmet Pristina, Dukagjin Emerlah and Najarije Hoti are charged with the criminal act of organised crime. The group's leader is believed to be Mehmet Pristina. He allegedly has organised, supervised and managed the activities of this organised criminal group, which, according to the Prosecutor, has actively participated in key criminal acts.
“has co-ordinated criminal activities and given orders and instructions to other members of this organised criminal group and other defendants who have co-operated according to these commands”, the prosecution claims.
“Najarje Hoti as judge of Pristina's Municipal Court, designed to judge for the benefit of Dukagjin Emerka, has acted as Mehmet Pristina's figure through an illegal court decision she has made on September 27th 2010 to co-operate with other members of this criminal group and to ensure that the decision is not complained and taken in the form of”.
Avni Maxu as the person responsible for finding potential buyers by acting as mediators, representing buyers in certain deals, and being removed as a lawyer or a defender by helping other members of this group, namely, Dukagjin Emer God, during the process of washing money and carrying droves to others, even by buying them himself and through his wife, some of us to carry out others, thus doing the criminal work.
Pristina and Emerlah are also accused of plundering.
The prosecution claims that Emerlah between September 27th 2010 and December 6, 2013, given that 36.45 hectares of social property had been acquired from criminal activities, respectively, that he had been given ownership of these properties through criminal activities by Judge Najarie Hoti, has initiated procedures to sell parcels.
Before the indictment was taken, and immediately thereafter, Emerlah has entered into agreements with Mehmet Pristina and others to carry social orders, even though he knew that ownership would be given to him through bias. These actions were committed by the Prosecutor to conceal the criminal origin of money.
Emerlah has declared and struck agreements with February 16, 2011, with Mehmet Pristina transferring him eight parcels of artificially low 10 euros per square metre.
On 23 May 2011, Emerlah made another deal with Mehmet Pristina in order to transfer him to eight parcels at a low price of 8.5 euros square metres.
Lands have been sold from 7 to 10 euros per square metre. A Mehmet Pristina parcel worth 3 euros per square metre has been sold to the cheapest. In one contract it has proved that one square meter of land has been sold for 36 cents. A field costing a minimum ten thousand euros, under the contract has been sold 36 euros.

Dukagjin Emerlah had followed suit by exercising a lawsuit at the Pristina Municipal Court. He filed his suit twice. For the review of the first indictment, exercised on June 5, 2008, Judge Selim Nikqi was appointed.
Nikki wrote them. The AKP asking their opinion on the matter. Emerlah had dropped the first indictment. He had presented the second who was appointed to Judge Najarrije Hoti.

During the procedure at the Municipal Court on July 17th 2010, Judge Hoti had issued a decision on temporary security measures for 53 land plots on the surface of 44.2 hectares. On September 7, 2010, Hoti has once again changed that decision, adding another story.
The AKP had filed complaints.
During the procedure and before deciding on the case, Judge Najarije Hoti had allowed Dukagjia Emerllahut and Mehmet Pristina to attend her office. Deals between them are counted by evidence discovered during checks made on their computers.
A copy of the first sales contract between Dukagjit Emerllahut and a third party regarding a plot of land has been found on the computer of Judge Hoti, along with other documents such as a copy of Emer God's request for the appointment of security measures on cadastral plots.
“Control of a computer belonging to Mehmet Pristina has found an unsigned copy of the act completed in the case of c.724/2009”.
On October 15, 2010, Judge Hoti has handed the sentence to the tribunal's driver, Vehap Hashan, saying that Mehmet Pristina and Dukagjin Emerullahu were outside her office and were waiting for her.
Mehmet Pristina and Dukagjin Emergua under the indictment have ordered Vehap Hashan to enter the white-collar Opel vehicle, with which Emerlah and Pristina take him to Rugova's restaurant and force him to give him the law. This act has had to be handed over to the AKP.
Mehmet Pristina, meanwhile, has lured Serpil Aliu with the aim of abuse of office. Pristina is also accused of paying Reshat Fetah official to AKP, an operation at the “hospital. Sistina” in Skopje, worth over 10,000 euros.
Pristina, according to the Pristina prosecution, had forced Serip Ali to prosecute the prosecution in the AKP by placing an earlier date on leafing, October 15th 2010. They used a false AKP stamp, the prosecution concluded.
Serpil Aliu, signed two leaflets and used forged seals to prove that the two authentic copies of the act had arrived in the AKP on October 15, 2010.

On May 17, 2011, Gani Ademi, senior legal official in the AKP, responded to a request by the Supreme Court's special chamber, stressing that the AKP had no information on any act of bias in the Communist Court's case in Pristina.

However, the AKP had no bias. It was Sellep Aliu who kept it in his office. Later, he had torn it because it was broken up with Mehmet Pristina.
At the end of June 2011, Dukagjin Emerllahut's lawyer, Wisar Wehapi, had been in AKP offices and had given Ashlan a copy of the first page of the act of judgment signed by Serpil Aliu.
But the indictment shows that Gani Ademi, who traced this subject, had subsequently ended up rendering services to businessman Mehmet Pristina.
With the influence of Mehmet Pristina, Gani Ademi KP official, has said the AKP has received a copy of the act, in order to confirm the release of the deadline for complaint.
