Father and son Ashref and Ejup Shemhir were sentenced today by the Court in Prizren for the triple murder and for assistance in the murder that took place on March 8, 2015, on International Women's Day.

The court ruled that the chief indictee Ashref Shemhirari, for the criminal offense of the serious murder, will be sentenced to effective prison terms during the length of 23 years. While for the crime of illegal possession of an automatic rifle and a gun received a two-year prison sentence.

The same court pronounced the sentence unique in length of 24 years in effective prison.

While the other accused, Ejup Shembulari, the son of Ashref, was found guilty of the criminal offence to support the perpetrators after committing a criminal offence and was sentenced to four and a half years in effective prison.

The courts, the accused, also charged them with the judiciary and the total of 800 euros. 500 euros for Ashref Shemnar and 300 euros for Ejup Shemira.

In his final address last week, prosecutor Genc Nxha changed the indictment in terms of accused Ejup Shemweari, from the heavy murder to co-ordination in the criminal offence of the heavy murder in aid. The prosecutor also gave up on Ejup Shemiraar for the illegal weapons-taking criminal work.

However, the court of accused Ejup Shemweari did not find him guilty even of the prosecutor's requalified work.

Ejup Shemajlar was not convicted of committing a criminal murder in aid, but was sentenced for the criminal offence of helping the perpetrators after committing a criminal offence.

Ashef Shemajtari and Ejup Shembulari were charged with violating the Penal Code of the Republic of Kosovo since March 8, 2015, about 14:10 minutes in Prizren on the <x0st Street Jashari-Quanova”, following an earlier preliminary dispute, deliberately deprived the life of late Ferdi Shisko, Hakki Thaci and Belgin Ersoy, all from Prizren.

The criminal incident, which was the subject of numerous discussions because of the genocideist past of those killed, ended with a total penalty of 28.5 years in prison.

History, Why Did It Get to This Murder?

The triple murder, which rocked the town of Prizren on Women's Day on March 8, 2015, turned out to be a problematic early days between suspects in murder and victims.

Two suspects had fled the scene after the shooting and were on the run until they surrendered to the police after several days.

The three people killed in 2015 were reprobates of criminal acts, also referred to as recivilists.

31-year-old Ferdi Shisko, citizen of Kosovo's ethnic Albanian affiliation, was married and father of a child, while having only three years of elementary school. At Prizren's Foundation Court, to figure out six criminal acts.

Three have to do with slight bodily injury, damage to playful wealth and tingling, while another work of heavy bodily injury has been associated with the other victim Belgin Ersoy.

The second victim, 36-year-old Belgin Ersoy, of Turkish nationality, had recorded five criminal acts. Three involved causing slight bodily injury, a crime of rowing, and the criminal offense of severe bodily injury committed in co-ordination with the victim Shisko.

While in the third victim, 32-year-old Haki Thaci, of Albanian nationality, also finds 3 criminal acts.

Of them a criminal offence, a crime of illegal weapons maintenance, and another criminal offence to cause general danger.

Past Between Charged for Murder and Victims

According to the prosecution indictment, on June 07th 2013, about 4: 00 p.m. in Prizren, on “Street. You see Jemini” right in the courtyard of the “Abi Center”, Ferdi Shisko and Belgin Ersoy, in their interactions they had caused bodily injury by temporarily damaging the health of the damaged Ashref Shemhir.

Until the injury was Ashref was drinking coffee, Shisko and Ersoy, from the rear had been stabbed and baseball bat, suitable tools for causing severe bodily injury, or serious health damage” is said in the prosecution indictment.

The shocks, the injury had taken them to the head, to the arm, and to the left shoulder, to the back, and to other parts of the body. These injuries were found in the opinion of forensic expert as serious bodily injuries.

In this case, which was evidently the beginning of the problem and had occurred in June 2013, the court had failed to hold any court hearings because the prosecution had gone to court after two years, more precisely in February 2015.

KA LLXO.com has found that the problems between the suspects and the victims had continued further, the victims had recently been at odds with the suspect's son.

In the body of the two victims, Ferdi Shisko and Hakki Thaci, weapons had been found that they had taken with them when the murder occurred.

Sayings in the Judicial Process

During the testing procedure, Jevvat Shisko, the father of the late Ferdi Shisko, killed in March 2015 in Prizren, testified to his son's past and efforts to reconcile with the Shembulari family.

Witness Shisko, before the court, claimed that his son, Ferdi, had sometimes had problems with different citizens.

Shisko, said he was also aware of the conflict his son Ferdi had had had with accused Ashref Shemhirar, who said he had been beaten hard, but did not know who Ferdi was with, because he said in the case he had only heard from others.

The Witness said that after the conflict that his son Ferdi had experienced, he had sometimes sent people according to tradition of forgiving, but for two years the Shemweary family had left him unanswered.

I asked for forgiveness, I told people to forgive me, people would go and say nothing, not my brother in Germany. I've done it again, but he's been looking for anything but who fired it (Ferdin) on Ashrefi”, he declared Jevat Shisko before the court.

The Witness had stated in court that Ferdin had not been pushed to fight Ashref and that after wording to Ferdi everything had happened by chance.

In his final address, prosecutor Genc Nijza changed the indictment as regards accused Ejup Shemweari, from the heavy murder to co-ordination in the criminal conduct of the serious murder to help. The prosecutor also gave up on Ejup Shemiraar for the illegal weapons-taking criminal work.

The prosecutor at the end demanded that the accused be found guilty and condemned according to the law.

The defender of the accused, Ashref Shemajhar, lawyer Mahmut Halimi, in the closing statement before the court said the lives of three deceased persons could be saved and not come to the killing, if the prosecution organs had acted on time, alluding to the failure to respond to the case where Ashref Shemajlar had been damaged.

Lawyer Halimi also mentioned the fact that the three deceased have at times disturbed the accused. In his view, however, investigative organs have failed to act on time.

Halimi also said that the critical day of the accused had gone out to get food for the family, while one of them, Ashref Shemwear, had also taken the gun.

The lawyer had stated that along the way, Ashrefi had stopped to ask the Frisier about the term, while the late were offered and told “don't make it soft, do you want to tame the boy?”

This, according to lawyer Mahmut Halimi, had been the moment that Ashref had pulled out his rifle in the trunk of the car that Ejupi directed and shot upon the deceased.

Lawyer Mahmut did not fail to mention before the court that the three who were felt both according to media reports and even on documentation had been known to law organs for their criminal past.

The two accused, father and son, Ashref and Ejup Shemweari, at the end of this process expressed regret over what had happened, they apologized to the victims' families at the courtroom, but family members had negative reactions.

Even the mother of the late Ferdi Shisko, reacted by saying our “requests when we took people we didn't even want to accept your apology. Our boys are eating this stuff.

After announcing today's conviction, the families of the victims dissatisfied with the court's sentences reacted, saying that “would use Kanun” if justice did not go properly.

They warned that they would file complaints against the court's decision.
