Amateur falsification of the Jurisprudence exam by State Prosecutor Musliu: Resigning and Prosecution

Yesterday, it was reported that the file for a law enforcement exam by Chief State Prosecutor Alexander Lumez is manipulated.

KTV, along with the “Justice Trust” team, has examined Lumez's file in the Kosovo Archives for several days.

As KTV reported, Lumez ' name is written in three variants in three different documents. While, under the light's influence, it is clear that under the name of Lumez finds another name, Zymer Krasniqi's one from Decani.

Regarding this scandal in Kosovo justice, Periscopi has contacted the author and journalist of the show “Justice Trust, Betim Musliu, who said it has proved that the state chief prosecutor's file is manipulated overall.

Lumez file is built on another file, Musliu said, and that it belongs to Zymer Krasniqi from Decani.

For this scandal, Musliu admits that the chief prosecutor should consider resigning and prosecute.

1. According to your research, do you find Alexander Lumze's jurisdiction exam false?

The Justice Vocation Commission in co-operation with KTV in recent days has investigated dozens of cases in Kosovo's Archives over allegations raised about the authenticity of the state chief prosecutor Alexander Lumez's jurisdictional exam. The research findings testify that the state chief prosecutor's file is manipulated overall. No data on key law-testing documents at all stages matches the case of Chief Prosecutor Lumez. The file of Chief Prosecutor Lumez is built on another file, which we have discovered belonged to Zymer Krasniqi from Decani. Research indicates that his file has been intervened with the lanx and that the file of Chief Prosecutor Lumez was built, in which numerous errors have been made in the case of manipulation, which testify that someone has made interference but has not been attentive to the intervention I make in the same way. Alexander Lumezi is in various documents of the jurisdictional exam written on Zymer Krasniqi's file, such as Aleksandar Lumezi and Aleksandar Ljumezi, in Latin and repeatedly in Cyrillic. The research findings are even more scandalous to testify to the manipulation of the file as a whole, but which will be discovered more widely tonight after the RTK news edition on the “Justice Trust” show.

2. Should Lumez resign after publishing this research based on concrete evidence?

The state chief prosecutor's position is one of the most important positions in Kosovo. The State Prosecutor's competencies led by the State Chief Prosecutor include investigating and prosecuting the perpetrators of criminal acts, including organised crime, high-level corruption, war crimes, money laundering and the political crimes that have occurred in Kosovo after the war. Such a position, of course, that in a democratic society where the minimum standards of good governance are applied, requires that it be guided by persons with credibility and uncontained personality. In this direction, Chief Prosecutor Lumezi must seriously examine all these circumstances in order to preserve image and credibility not only of the prosecutorial system, the justice system but also of the Republic of Kosovo.

Also, the Kosovo Prosecutorial Council needs to comply with the competencies and responsibilities given to the Constitution and the Law to the Prosecutorial Council urgently address this issue and make decisions, through prosecutorial system mechanisms, that independently, impartial and professionally ensure that this case is investigated in accordance with the law. Personally, I believe that if there is no creation of an independent body for investigating this case, which will consist of the majority of members that should be from the international community, respectively, the American, British and German, then I suspect even this manipulated file scandal will close as if 90% of high profile corruption cases.

3. Besides resigning, should he also be prosecuted for his counterfeiting?

The investigation and prosecution concerning each case should be based on facts and evidence as a result of an independent and undicted process. During research based on documentation provided in the Kosovo Archive, we have found evidence that the file is entirely manipulated. That's more than enough for prosecutors to take this case down and other cases of manipulated files that connect to the law test. Likely, the scandal will have enormous proportions because manipulations do not stop with chief prosecutor Lumezi's file. Any decision concerning this issue should be conveyed to the public in confidence, that the law is equal and implemented as such for all.

5. Is this the biggest scandal in Kosovo's field of justice?

Doubts raised over the UN Chief State Prosecutor Alexander Lumezi's jurisdiction exam, in fact testify to the reality in Kosovo, which we talk about every day as citizens, journalists, civil society and international communities. Despite the fact that Kosovo, since the post-war has been accompanied by scandals, with a lack of results in fighting organised crime and corruption, with gold theft at police stations, theft of testimony rooms, and many other scandals, this scandal of manipulation of the State Chief Prosecutor's file, Alexander Lumezi, no doubt constitutes one of the biggest scandals in the Republic of Kosovo, which should be handled more urgently by the prosecution's organs.
